Use of web.Best:

1. Overview of our web.Best Services

These Terms apply to your access and use of web.best's services, including our website creation tools, video streaming options, custom domain connection, website integrations, digital marketing assistance and other products and services (collectively, "Services"). By using our Services, you agree to be bound by these Terms, as well as our Privacy Policy and other operating rules we publish via our Services. Our Services are provided "as is." web.Best, along with its suppliers and licensors, disclaims all warranties, whether express or implied, to the fullest extent permitted by applicable law. This includes, but is not limited to, any warranties of merchantability, suitability for intended use, and non-infringement. Neither web.Best, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

2. Your web.Best Account

Creating an account with web.Best requires accurate and current information so we can communicate with you about updates, changes to our Terms, and your account. We may limit your access to our Services until we're able to verify your account information, like your email address. You are responsible for all activity under your account, including maintaining the security of your login credentials. Notify us immediately if you suspect unauthorized access to your account. When you create a web.Best account, we consider that to be an inquiry about our products and services, which means that we may also contact you to share more details about our services and what we have to offer. We may need to send you also emails about notable updates (like changes to our Terms of Service or Privacy Policy), or to let you know about legal inquiries or complaints we receive about the ways you use our Services so you can make informed choices in response.

3. Website Management and Web Application

The management of your web.Best website is conducted exclusively through our dedicated web application accessible at app.web.best. This web application is optimized for desktop and tablet devices, providing you with a comprehensive interface to create, edit, and manage your short-video websites. The web application allows you to upload videos, customize your website design, manage your content, configure settings, connect custom domains, and access analytics. By using our Services, you acknowledge that website management features are only available through the web application on desktop and tablet devices, and mobile phone access to the management interface may be limited or unavailable. We recommend using a desktop or tablet device with a modern web browser for the best management experience.

4. Minimum Age Requirements

Our Services are not intended for use by children. If you are under the age of 13 (or 16 in Europe), you are not permitted to use our Services. Users under 18 must use our Services only under the supervision of a parent or legal guardian who agrees to these Terms.

5. web.Best User Agreement

web.Best enables you to create visually appealing short-video websites with ease, and we're excited for you to use it. By signing up, you'll gain access to various plans offering different features and capabilities such as premium features and integrations. We don't claim ownership of your content, so you retain full rights over anything you publish on your website. However, we ask that you publish responsibly, ensuring that your site remains free of prohibited content containing ip infringements, scam, phishing, malware, botnets, or any material inciting violence.

6. Subdomains and URLs

When you create a website on web.Best, you receive a free subdomain, such as username.sites.best. Users are prohibited from engaging in "domain squatting," claiming an unreasonable number of subdomains, or selling access to subdomains without permission.

7. Content License

By sharing or uploading content to web.Best, you grant us a global, royalty-free, transferable, and non-exclusive license to use, reproduce, modify, and distribute the content for the purpose of improving and/or promoting our Services. This may include making publicly available content accessible to select third parties for distribution through their platforms such as the Best app (https://www.app.best). Users on web.Best may share or repost portions of your content, provided they credit you as the original author with a link back to your website.

8. Content Removal

If you delete content, web.Best will make reasonable efforts to remove it from public view, although cached versions or external references may persist temporarily.

9. Web Traffic

web.Best may use third-party services to measure site traffic and audience. By hosting a website on web.Best, you agree to assign your website's traffic to us, and we reserve the right to sign a Traffic Assignment Letter on your behalf. This means web.Best may receive aggregated credit for your website's traffic, and you may be asked to provide proof of website ownership if needed.

10. Acceptable Use

Users must adhere to web.Best's User Guidelines, ensuring content and activities do not violate community standards. Illegal content, scam, spam, and harmful practices are strictly prohibited. For video uploads, users must also comply with our Video Guidelines.

11. Video Guidelines

We're excited to offer a high-quality video streaming platform with CDN to help you engage audiences worldwide, and these guidelines clarify a few basic expectations to ensure smooth use of our video service. Videos should be played using the web.Best video player exclusively on the web.Best user website where the service was purchased; sharing direct video links or using our platform to host content for external sites is prohibited. Video uploads are limited to a maximum of 60 seconds in length and 1080p resolution, with 4K video support coming soon. Additionally, each uploaded video will automatically generate a cover image from an extract unless the user opts to set a custom cover image that better represents their video. While we don't set fixed limits on storage or bandwidth outside your plan's coverage, we expect usage to align with the normal activity of a typical website. In rare cases of disproportionate or unreasonable use for a personal or business website, we may limit or discontinue service. All videos are subject to our content policies, and prohibited material, including mature or harmful content, is not allowed. 12. Security and HTTPS

web.Best provides free HTTPS for all sites by default, including custom domains, through Let's Encrypt. By using a custom domain, you authorize us to act on your behalf for the sole purpose of enabling HTTPS.

13. Attribution

web.Best may place an attribution in your website footer or toolbar indicating that it is powered by web.Best. Premium plans and higher offer the option to remove this attribution. For more details on altering or removing this attribution, please refer to our Attribution Options.

14. Custom Domains

Domain name services on web.Best are offered in partnership with third-party registrars, and users are bound by the registrar's terms and relevant policies, including ICANN guidelines. When you register a custom domain with third-party registrars, you're required to provide complete and accurate registration information, and you must keep this information current. In most cases, the contact information you provide as part of the registration process will be used as your administrative contact, technical contact, and billing contact for the domain.

15. Content Responsibility

Content created and posted via our Services is your sole responsibility. web.Best does not control or monitor user content but reserves the right to remove or disable content that violates our policies or applicable laws. You agree to not post harmful, offensive, or illegal content, or to infringe on the intellectual property rights of others.

16. Visitors and Users Responsibility

We haven't reviewed, and can't review, all of the content (like text, photo, video, audio, code, computer software, items for sale, and other materials) posted to or made available through our Services by users or anyone else ("Content") or on websites that link to, or are linked from, our Services. We're not responsible for any use or effects of Content or third-party websites. We don't have any control over third-party websites. A link to or from one of our Services does not represent or imply that we endorse any third-party website. We don't endorse any Content or represent that Content is accurate, useful, or not harmful. Content could be offensive, indecent, or objectionable; include technical inaccuracies, typographical mistakes, or other errors; or violate or infringe the privacy, publicity rights, intellectual property rights, or other proprietary rights of third parties. You're fully responsible for the Content available on your website, and any harm resulting from that Content. It's your responsibility to ensure that your website's Content abides by applicable laws and by the Agreement. We aren't responsible for any harm resulting from anyone's access, use, purchase, or downloading of Content, or for any harm resulting from third-party websites. You're responsible for taking the necessary precautions to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. Any Content that's for sale through any of our Services is the seller's sole responsibility, so you must look solely to the seller for any damages that result from your purchase or use of Content. We are not a party to, and will have no responsibility or liability for, any communications, transactions, interactions, or disputes between you and the provider of any Content. Please note that additional third-party terms and conditions may apply to Content you download, copy, purchase, or use.

17. Plans and Fees

For paid features of web.best's Services, you agree to the specified plans & fees. We offer multiple subscription tiers to suit different needs, from individual creators to large enterprises. All subscription fees are billed monthly and exclude applicable VAT.

If your usage exceeds your plan's limits (videos hosted or monthly streams), you may need to upgrade to a higher tier plan to continue service without interruption. web.Best reserves the right to limit or suspend services if usage significantly exceeds plan allocations without upgrading.

18. Plan Changes and Upgrades

You may upgrade or downgrade your plan at any time through your account settings. When upgrading, the new plan takes effect immediately, and you'll be charged the prorated difference for the remainder of the billing period. When downgrading, the new plan takes effect at the start of your next billing cycle. If your content (number of videos) or usage (streams) exceeds your new plan's limits at the time of downgrade, you may be required to reduce your content or maintain your current plan until usage falls within the new plan's limits.

19. Taxes

To the extent permitted by law, or unless explicitly stated otherwise, all fees do not include applicable federal, provincial, state, local or other governmental sales, value-added, goods and services, harmonized or other taxes, fees, or charges ("Taxes"). You're responsible for paying all applicable Taxes relating to your use of our Services, your payments, or your purchases. If we're obligated to pay or collect Taxes on the fees you've paid or will pay, you're responsible for those Taxes, and we may collect payment from you.

20. Payment

You must provide accurate and up-to-date payment information. By providing your payment information, you authorize us to store it until you request deletion. If your payment fails, we suspect fraud, or Paid Services are otherwise not paid for or paid for on time (for example, if you contact your bank or credit card company to decline or reverse the charge of fees for Paid Services), we may immediately cancel or revoke your access to Paid Services without notice to you. You authorize us to charge any updated payment information provided by your bank or payment service provider (e.g., new expiration date) or other payment methods provided if we can't charge your primary payment method.

All charges will be billed to your online account monthly. You will be responsible for all charges in your online account, and will pay all charges in Euros. Late payments may bear interest at the rate of 3% per month (or the highest rate permitted by law, if less).

To the fullest extent permitted by law, you waive all claims relating to charges unless claimed within 30 days after the charge (this does not affect your credit card issuer rights).

Nothing in these terms obligates web.Best to extend credit to any party. You acknowledge and agree that any credit card and related billing and payment information that you provide to web.Best may be shared by web.Best with companies who work on web.Best's behalf, such as payment processors or credit agencies, solely for the purposes of checking credit, effecting payment to web.Best and servicing your account.

web.Best may also provide information in response to valid legal process, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims. web.Best will not be liable for any use or disclosure of such information by such third parties.

web.Best reserves the right to discontinue the provision of the services to you for any late payments.

web.Best may change the fees and the payment policies for the services with 30 days prior notice.

Any outstanding balance becomes immediately due and payable upon termination of the terms for any reason.

You may not access the web.Best services in a manner intended to avoid incurring fees.

21. Refunds

There are no refunds and all payments are final. We may have a "no-show policy" for our Paid Services that require your participation. This means that if you don't show up, login, connect your domain, don't use your website, don't post content, or are late for a scheduled session, you'll still be charged for the Paid Service and won't be entitled to a refund.

22. Free Trial and Promotional Offers

From time to time, we may offer free trials or promotional pricing for certain plans or features. These offers are subject to the specific terms disclosed at the time of the offer. Unless otherwise stated, after a free trial period ends, you will automatically be charged for the plan at the regular subscription rate unless you cancel before the trial period expires. Promotional pricing may revert to standard pricing after the promotional period ends. We reserve the right to modify or cancel promotional offers at any time.

23. Fees Paid to Third-Party Websites or Website Owners

Website owners can sell items (goods, content, services, etc.), offer subscriptions for their websites at specific price points and intervals, or simply collect payments. We're not involved in a website's subscription details or store operations (including the quality, timing, pricing, or legality of what may or may not be included in exchange for payment, or any goods or services purchased). If you buy items or subscriptions from a website, you're making the purchase directly from the website owner, and they're solely responsible for the items sold. Please contact the website owner if you have any questions or complaints.

24. Third-Party Integrations

You may use third-party integrations with our Services. These third-party services are subject to their own terms, which may apply separately from these Terms. web.best is not liable for issues caused by third-party integrations.

25. Intellectual Property

web.best retains ownership of its trademarks, content, and technology associated with our Services. By using our Services, you do not gain ownership rights over web.best's intellectual property. The web.Best name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of web.Best or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on our Services are the trademarks of their respective owners.

26. Data Backup and Recovery

While we implement reasonable backup procedures for our Services, you are solely responsible for maintaining backups of your content. web.Best is not responsible for any loss or corruption of your data, and you agree that web.Best shall have no liability for any such loss or corruption. We strongly recommend that you regularly backup your content independently.

27. Service Availability and Maintenance

We strive to provide reliable and continuous access to our Services. However, we may occasionally need to perform scheduled maintenance or emergency repairs. We will make reasonable efforts to notify you in advance of scheduled maintenance that may affect your access to the Services. web.Best is not liable for any temporary unavailability of Services due to maintenance, updates, or technical issues beyond our reasonable control.

28. Changes to the Terms

We may update these Terms from time to time to reflect changes in our services or for legal reasons. If material changes occur, we'll notify you through our Services or via email to the address associated with your account at least 30 days before the changes take effect. Continued use of the Services after changes take effect signifies your acceptance of the new Terms. If you do not agree with the modified Terms, you should discontinue your use of the Services.

29. Account Termination and Suspension

web.best may terminate or suspend your access to the Services at any time, with or without cause or notice, including but not limited to violations of these Terms, fraudulent activity, non-payment, or abusive behavior. You may also terminate your account at any time through your account settings or by contacting support. Upon termination, your right to use the Services will immediately cease, and we may delete your account and content. If your account is terminated due to violation of these Terms, you may not be entitled to a refund for any paid services. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

30. User Data and Privacy

Your use of our Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. We collect, use, and protect your personal information as described in our Privacy Policy. You agree to our collection and use of your information as set forth in the Privacy Policy. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms and you agree to these Terms on behalf of that organization.

31. Indemnification

You agree to indemnify, defend, and hold harmless web.Best, its affiliates, and their respective officers, directors, employees, agents, and representatives from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your content; (c) your violation of these Terms; (d) your violation of any rights of another party, including any intellectual property rights; or (e) any harmful or unlawful activity connected with your account. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

32. Disclaimers and Limitations of Liability

Our Services are provided "as is" and "as available," without warranties of any kind, either express or implied. web.best and its affiliates disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

In no event will web.Best, or its suppliers, partners, or licensors, be liable (including for any third-party products or services purchased or used through our Services) with respect to any subject matter of the Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental, punitive, or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; (iv) for any loss of revenue, profits, or business opportunities; or (v) for any amounts that exceed 50 Euros or the fees paid by you to web.Best under the Agreement during the six (6) month period prior to the cause of action, whichever is greater. web.Best shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

If we cause damage to you and you are a consumer in Europe, we limit our liability to the maximum amount permissible in your country of residence. Liability will be limited to foreseeable damages arising due to a breach of material contractual obligations typical for this type of contract. web.Best isn't liable for damages that result from a non-material breach of any other applicable duty of care. This limitation of liability will not apply to any statutory liability that cannot be limited, to liability for death or personal injury caused by our negligence, liability caused by our willful misconduct or gross negligence, or our responsibility for something we have specifically promised to you. You and we agree that we and our affiliates' total liability is limited to the greater of 50 euros or the amount paid by you to use our Services during the 6 months preceding the claim. To the extent that our liability is limited or excluded, the limitations or exclusions will also apply to the personal liability of our employees, legal representatives, and vicarious agents.

33. Prohibited Conduct

You agree not to engage in any of the following prohibited activities when using our Services:

• Using the Services for any purpose that is illegal or prohibited by these Terms
• Interfering with the security or proper functioning of the Services
• Using any automated system, including but not limited to robots, spiders, scrapers, or offline readers, to access the Services in a manner that sends more requests to our servers than a human could reasonably produce in the same period
• Engaging in any use of our Services that does not strictly comply with this Agreement
• Violating any applicable laws or regulations, including laws related to online conduct, content standards, licensing, privacy, data protection, data export, financial services, consumer protection, unfair competition, and false advertising
• Using the Services for unlawful purposes, publishing illegal content, or furthering illegal activities
• Infringing or misappropriating the intellectual property rights of web.Best or any third party
• Overburdening or interfering with our systems or imposing an unreasonable or disproportionately large load on our infrastructure, as determined by us in our sole discretion
• Disclosing the personal information of others without proper authorization
• Using the Services to send spam, bulk unsolicited messages, or unauthorized communications
• Interfering with, disrupting, or attacking any service or network associated with our Services
• Creating, distributing, or enabling content that facilitates or operates alongside malware, spyware, adware, or other malicious code
• Reverse engineering, decompiling, disassembling, deciphering, or attempting to derive the source code for any non-open-source technology related to the Services
• Renting, leasing, loaning, selling, or reselling the Services or related data without our prior consent
• Creating multiple accounts to circumvent plan limitations or abuse free trials
• Attempting to bypass any content filtering, security measures, or access controls
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity
• Engaging in any activity that could harm minors in any way

34. Copyright and DMCA Policy

web.Best respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our Services, please notify our copyright agent with the following information:

• Identification of the copyrighted work claimed to have been infringed

web.Best is committed to protecting our users from abusive copyright claims, commonly known as "copyright trolling," where baseless or exaggerated claims are made to pressure or intimidate website owners. To foster a fair and creative environment, web.Best only addresses legitimate copyright claims that include verifiable proof of ownership and comply with applicable legal standards. We reserve the right to reject claims that are unsubstantiated, excessive, or made in bad faith, and we support users in filing counter-notifications when faced with baseless claims. Repeated or malicious claimants may be restricted or blocked from accessing our claims process, and web.Best may take further action to protect users from harassment or extortion. We may also report suspected copyright trolling activities to appropriate authorities. 36. Dispute Resolution and Arbitration

37. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of Paris, France. You consent to the personal jurisdiction of such courts and waive any objection as to inconvenient forum.

38. Force Majeure

web.Best shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

39. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. The failure of web.Best to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

40. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or additional terms published by web.Best on or through the Services, constitute the entire agreement between you and web.Best concerning the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and web.Best regarding the Services.

41. Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice to you. Any attempted assignment in violation of this section shall be null and void.

42. Language

These Terms may be translated into other languages for your convenience. In the event of any conflict between the English version and any translation, the English version shall prevail.
